Booking Conditions

All properties are marketed and managed by Duquesa Estates Rentals S.L. on behalf of their owners. The accommodation contract is made between the guest and the property owner, with Duquesa Estates Rentals S.L. acting solely as the owner's authorised managing and booking agent.

 

1. Contract

A binding contract arises when a booking is confirmed by Duquesa Estates Rentals S.L via email  . This contract is governed exclusively by Spanish Law and the jurisdiction of the Spanish courts. The person making the booking accepts these conditions on behalf of all party members.

2. Pricing & Payments

• Price Guarantee: Advertised prices are subject to change. However, once a booking is confirmed and paid in full, the price is guaranteed not to increase.
• Deposit: A non-refundable 20% deposit per property is required to secure a booking.
• Balance: The remaining balance must be paid at least 6 weeks (42 days) prior to arrival. If booking within 6 weeks of arrival, full payment is required immediately.
• Failure to Pay: Failure to pay the balance by the due date constitutes a cancellation by you, resulting in a forfeited deposit.

3. Cancellations & Amendments by You

Cancellations or amendment requests must be made by the lead guest via email or telephone. Cancellations take effect on the day written notice is received.

Cancellation charges are applied as follows:

• More than 42 days before arrival: Loss of deposit (20%)
• 29 to 42 days before arrival: 50% of total holiday price
• 15 to 28 days before arrival: 75% of total holiday price
• 1 to 14 days before arrival: 100% of total holiday price

4. Cancellations & Amendments by Us

We reserve the right to alter or cancel bookings. If we must cancel your booking (except for non-payment or Force Majeure), we will offer equivalent or upgraded alternative accommodation, or a full refund.

If a significant change (e.g., lower standard property) is made and rejected by you, a full refund will be issued. No compensation is paid for cancellations or amendments by us that are out of our control.

5. Security Deposits & Property Damage

Upon key collection, guests must sign a registration form and provide a valid debit / credit card.

• You authorize Duquesa Estates Rentals S.L to charge this card up to €500.00 for major damage, breakages, extra deep-cleaning, or missing items (including keys and garage remotes).
• Normal minor wear-and-tear (e.g., a broken glass) will not be charged.
• This cap does not limit your overall liability; you remain fully responsible for the cost of any damage exceeding €500.00.

6. Guest Responsibilities & Occupancy

• Property Care: You are responsible for keeping the accommodation clean and tidy. You assume liability for the actions of all party members and invited visitors.
• Occupancy Limits: Property owners reserve the right to refuse entry if guests exceed the property's maximum capacity. Tents, caravans, and motorhomes are strictly prohibited on property grounds.

7. Property Access & Housekeeping

• Mid-Stay Clean: For stays of 11 nights or more, linen and towels are changed weekly or mid-stay whenever possible. If a housekeeper is turned away, the clean cannot be rescheduled due to tight schedules.
• Maintenance Access: Authorized staff or contractors may enter the property during your stay for essential maintenance or safety reasons. We will endeavor to notify you in advance.

8. Facility, Utility & Parking Limitations

• Appliance Breakdowns: Properties are checked regularly. In the event of an appliance, Wi-Fi, or air conditioning breakdown, we will arrange repairs as quickly as possible. Duquesa Estates Rentals S.L is not liable for contractor delays, and compensation will not be offered.
• Communal Facilities: Access to shared amenities (pools, lifts, communal Wi-Fi) is managed by community associations. Availability is not guaranteed, does not form part of your booking contract, and no refunds are given for their closure.
• Parking: Allocated parking is provided strictly at the vehicle owner's risk. Duquesa Estates Rentals accepts no liability for vehicle damage, theft, or loss of items left inside.

9. Liability, Safety & Complaints

• Our Liability: Duquesa Estates Rentals S.L accepts responsibility for death, injury, or loss only if caused by the direct negligence of our employees or authorized agents. We are not liable for actions of unrelated third parties, your own negligence, or business losses.
• Local Standards: Safety regulations apply to Spanish standards, which may differ from your home country. Please report any defective fixtures immediately. Travel insurance is highly recommended.
• Complaints: Guests must report any issues during their stay and before departure, allowing us a reasonable opportunity to investigate and rectify the matter. We cannot be held responsible for issues that were not reported during the stay where we were denied the opportunity to resolve them.

10. Force Majeure

Duquesa Estates Rentals S.L is not liable or responsible for booking alterations, cancellations, or disruptions caused by events beyond our control. This includes war, terrorism, civil strife, industrial disputes, natural disasters, adverse weather, floods, fire, or disease outbreak.

11. Website Accuracy

Website content is informational and updated continuously. Distances are approximate. Local attractions or facility availability may vary. Please verify all pricing and property details at the exact time of booking.

12. Data Protection (GDPR)

Duquesa Estates Rentals securely records and processes your personal data strictly in accordance with European Data Protection regulations (GDPR). Data is used solely for secure booking administration, billing, and accounting purposes. Your personal data will never be shared with third-party marketing organizations.
